Bijeenkomst werkgroep Ethiek en gezondheid

We bespreken in elk geval een stuk van Hafez Ismaili M’Hamdi, getiteld Nudges and capabilities.
Abstract: Behavioral insights have shown that the way a choice environment is structured influences people’s choice behavior. This descriptive insight has been used to introduce interventions or nudges that purportedly steer people towards favorable outcomes while preserving alternative options. This Libertarian Paternalistic move from a descriptive insight to a normative approach is not without ethical concern. Public health nudges, specifically in the domain of preconception care, will be used to demonstrate these concerns. We will argue that not all adverse perinatal outcomes resulting from cognitive limitation are eligible to be corrected using nudges. To demonstrate this, Sen’s two notions of irrationality will be introduced. Furthermore, Libertarian Paternalistic nudges may have insufficient respect for autonomy and fail to recognize women’s ability to adapt their perinatal perception to their constrained living conditions. Sen’s capability approach will be introduced as a theoretical, evaluative and empirical tool to overcome charges of insufficient respect for autonomy and the problem of adaptation. Libertarian Paternalism supplemented by Sen’s two notions of irrationality and Sen’s capabilities approach is used to establish the ambit of ethically justifiable nudges in public health.
